Terms of Service

These Terms of Service ("Terms") govern your access to and use of CurbPilot's website, application and services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use CurbPilot

The Service is for businesses. You must be at least 18 and authorized to act for the business you register. You're responsible for keeping your login credentials secure and for all activity under your account.

2. What CurbPilot does

CurbPilot helps exterior home-service contractors identify qualifying homes in a chosen service area using property data and imagery and (optionally) designs, prints and mails postcards to those homeowners on your behalf. Availability of specific features and territories may change over time.

3. Accounts, plans and territories

• Subscriptions, paid plans are billed in advance on a recurring basis through our payment processor, Stripe, until cancelled.
• Territories, some plans reserve a service area or ZIP codes for you. Exclusive territory reservations are subject to availability and the limits shown at checkout and remain reserved only while your subscription is active and in good standing.
• Done-for-you mail, if you enable done-for-you mailing, you authorize us to charge your saved payment method per mailing based on the number of postcards sent, at the rate shown in the app before you confirm a batch.

4. Billing, renewals and cancellation

• Subscriptions renew automatically for the same term unless you cancel before the renewal date.
• You can cancel anytime from your account; cancellation stops future renewals. Access continues until the end of the paid period.
• Except where required by law, payments are non-refundable, including amounts already spent to print and mail postcards.
• If a charge fails, we may suspend the Service and release any reserved territory.
• Prices may change; we'll give notice before a change affects your renewal. "Founding" pricing, where offered, applies only while your subscription remains continuously active.

5. Your responsibilities and acceptable use

• You are solely responsible for the offers, claims, pricing, licensing and branding on your postcards and for complying with all laws that apply to your marketing and your trade (including advertising, licensing and mailing rules).
• You must honor do-not-mail and opt-out requests you receive and promptly notify us of addresses to suppress.
• You will not use the Service to send unlawful, deceptive, harassing, or infringing content, or to target recipients in violation of law.
• You will not misuse the Service, attempt to access it in unauthorized ways, resell it, or reverse-engineer it.

6. Third-party data and no guarantee of results

The Service relies on third-party property data and imagery, which may be incomplete or inaccurate. We identify homes that appear to match your criteria; we do not verify every property and we do not guarantee that any home qualifies, that any address is deliverable, or that you will receive calls, leads, jobs, or revenue. Results depend on many factors outside our control, including your offer, market and follow-up.

7. Intellectual property

CurbPilot and its software, design and content are owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is active. You keep ownership of the logos, images and content you upload and you grant us the license needed to design, print and mail your postcards and operate the Service. You confirm you have the rights to everything you upload.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will be accurate or complete.

9. Limitation of liability

To the maximum extent permitted by law, CurbPilot and its owners and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.

10. Indemnification

You agree to defend and indemnify CurbPilot from claims, damages and costs arising out of your postcards and offers, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends; sections that by their nature should survive will survive.

12. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute not subject to other agreed resolution.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date and for material changes we'll provide additional notice where appropriate. Continuing to use the Service after changes take effect means you accept the updated Terms.
